These Terms and Conditions govern all services provided by Spear Systems Inc. to its clients. By purchasing any service or checking the agreement box at checkout, you acknowledge that you have read, understood, and agree to be bound by these terms.

SMS Disclosure

By opting in to our SMS services, you agree to receive text messages related to notifications, service updates, account authentication, and other communications related to your account. Message frequency will vary based on your account activity.

Standard message and data rates apply according to your mobile carrier's terms.

To opt out of SMS communications at any time, reply STOP to any message you receive. For assistance, reply HELP.

Messaging Consent

You must explicitly consent to receive messages from Spear Systems Inc. Consent may be provided through our website sign-up forms, onboarding documentation, or verbally through a customer service interaction.

Subscription Plan and Billing

Contractor Platinum $597/Month (Currently Sold Out)

The Contractor Platinum plan is currently sold out and unavailable for new sign-ups. When available, this plan includes:

• In-depth Google My Business optimization

• Google Ads management

• Google Analytics and Tag Manager setup

• Custom marketing strategy

• Lead quality tracking

• Active ad optimization

Contractor Premium $297/Month

The Contractor Premium plan includes:

• A fully built, custom website (10 to 20 pages)

• Missed call text back automation

• Automated review generation system

• Automated remarketing system for re-engaging past leads

• Local SEO optimization

• Access to the Spear Systems mobile app and platform

• A dedicated account manager and support team

Subscriptions are billed on a month-to-month basis. Your first payment initiates the build process. All fees are billed in advance of the service period and automatically renew until cancelled.

Usage-Based Charges

Clients may incur additional charges based on usage of phone numbers, SMS and MMS messaging, and voice calls processed through the platform. These are billed separately from your monthly subscription and are determined by your usage volume. A detailed breakdown of per-unit rates will be provided within your client documentation.

Clients maintain a digital wallet for these usage charges. When your wallet balance runs low, you will be automatically billed based on your selected auto top-up preference.

No Refund Policy

All payments made to Spear Systems Inc. are final and non-refundable, including both subscription fees and usage charges. By signing up for our services, you acknowledge that our products are custom-built, immediately initiated, and non-reversible once delivery has begun.

Chargebacks

You agree not to initiate a chargeback or payment dispute for services rendered. Doing so constitutes a violation of this agreement. Spear Systems Inc. reserves the right to submit evidence of contract acceptance, platform usage, and delivery documentation in response to any dispute.

In the event of a fraudulent chargeback, Spear Systems Inc. may pursue recovery of the full amount owed plus any associated legal or collection fees.

Cancellation Terms

You may cancel your subscription at any time after your first month. Cancellation takes effect at the end of the current billing cycle and no further charges will be made beyond that point.

Upon cancellation, you will lose access to all features and systems built and set up for you. This includes your website, automations, mobile app access, and all connected tools. No partial refunds will be issued for unused time within a billing period.

Delivery of Services

Services are considered rendered and fulfilled once:

• Your website has been completed and delivered

• Platform and automation setup has been finalised

A Go-Live call will be conducted to walk you through your completed build. Login assistance and onboarding support may be provided but are not a prerequisite for the fulfilment of services.

Standard build and setup time is between 5 and 11 business days from the date your development form is submitted.

Payment Failures and Service Suspension

If a payment fails, Spear Systems Inc. will attempt to process the payment up to 3 times over a 3-week period. If the balance remains unpaid within 48 hours of the first failed attempt, your account and platform access will be suspended until payment is received.

Message Delivery

Spear Systems Inc. does not guarantee that automated messages will be delivered without delays or failures. Such issues may occur due to factors outside of our control including network problems, carrier filtering, or device compatibility.

User Obligations

When using our platform and messaging services, you agree to comply with all applicable laws and regulations. You must not use any part of our service to send messages that are offensive, illegal, or intended to harass or harm others.

Free Trials and Promotions

Spear Systems Inc. may from time to time offer promotional pricing or limited trials. During any trial period, limited setup may occur for information-gathering purposes only. Full services are rendered once billing begins. Promotional pricing does not modify any other terms of this agreement.

Changes to Terms

Spear Systems Inc. reserves the right to update these Terms and Conditions at any time. Changes will be communicated via our website or directly to clients where applicable. Continued use of the service following any changes constitutes acceptance of the revised terms.
